1.What this licence is
The Yuga apps are licensed to you, not sold. This page sets out the licence (the end-user licence agreement, or “EULA”) between you and Hriday Vanka, the developer, for the app on your phone or tablet. It sits alongside the Terms of Use, which cover Yuga as a whole; where they overlap, they are read together, and nothing here reduces your rights under the Terms or under consumer law.
- On iPhone and iPad (App Store): Apple’s Standard Licensed Application End User License Agreement applies, together with the additional terms in sections 2 and 3.
- On Android (Google Play) and any other device: the licence in section 4 applies.
2.On iPhone and iPad: Apple’s Standard EULA
If you got Yuga from the App Store, your licence to use the app is Apple’s Standard Licensed Application End User License Agreement (the “Standard EULA”), in which I am the “Application Provider”. The Standard EULA lets an app be subject to further terms; the Terms of Use, the Acceptable Use Policy, the AI and Content Policy and section 3 below are those further terms. If they conflict with the Standard EULA about the licence to use the app on Apple devices, the Standard EULA prevails.
3.Terms Apple requires
You and I agree that:
- This licence is between you and me only, not Apple. I, not Apple, am solely responsible for the Yuga app and its content.
- Your licence is a non-transferable licence to use the app on Apple-branded products that you own or control, as the Usage Rules in the Apple Media Services Terms and Conditions allow (including use by other accounts through Family Sharing or volume purchasing where that applies).
- Maintenance and support are my responsibility alone (contact below). Apple has no obligation to provide any maintenance or support for the app.
- Warranty. I am solely responsible for any product warranty, whether express or implied by law, to the extent not effectively disclaimed. If the app fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price you paid for the app (the app is free, so that is nothing); to the maximum extent the law allows, Apple has no other warranty obligation, and any other claims, losses, liabilities, damages, costs or expenses from a failure to conform to a warranty are my responsibility.
- Product claims. I, not Apple, am responsible for dealing with any claims by you or a third party about the app or your possession or use of it, including product liability claims, claims that the app fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar law. This licence doesn’t limit my liability to you beyond what the law permits.
- Intellectual property. If a third party claims that the app or your possession and use of it infringes their intellectual property rights, I, not Apple, am solely responsible for investigating, defending, settling and discharging the claim.
- Legal compliance. You confirm that you are not located in a country subject to a United States Government embargo or designated by the United States Government as a “terrorist supporting” country, and that you are not listed on any United States Government list of prohibited or restricted parties.
- Developer name and address. Questions, complaints or claims about the app go to Hriday Vanka, Hyderabad, Telangana, India, India; email support@foundationalcreations.com.
- Third-party terms. You must comply with any applicable third-party terms when using the app, for example your mobile network’s terms and the terms of Google or Apple sign-in.
- Third-party beneficiary. Apple and Apple’s subsidiaries are third-party beneficiaries of this licence, and once you accept it Apple has the right (and is deemed to have accepted the right) to enforce it against you as a third-party beneficiary.
4.On Android and other devices: the licence
If you got Yuga from Google Play or anywhere other than the App Store, I grant you a personal, worldwide, non-exclusive, non-transferable, revocable licence to download, install and use the app, free of charge, on devices you own or control, for your own personal, non-commercial use, under the Terms of Use.
You may not, except as the law expressly allows despite this restriction:
- copy, modify, translate or make derivative works of the app;
- decompile, reverse engineer or disassemble it, or try to find its source code;
- rent, lend, sell, sublicense, distribute or publish it, or offer it as a service to others;
- remove or change any notice of ownership, label or AI marking in the app or in what it produces;
- use it to build a competing product or to train an AI model; or
- use it in breach of the Acceptable Use Policy or the law.
Google Play’s terms also apply to how you get the app. Google is not a party to this licence and is not responsible for the app.
5.In-app purchases
The app is free. Yuga Plus (an auto-renewing subscription) and minute packs (a consumable purchase) will be offered as in-app purchases; they are not on sale yet. When they are:
- they are bought, billed, renewed, cancelled and refunded through the App Store (under the Apple Media Services Terms and Conditions) or Google Play (under the Google Play Terms of Service), and the Subscription Terms describe what you get;
- a subscription renews automatically until you cancel it in the store at least 24 hours before the end of the period; deleting the app or your account doesn’t cancel it;
- minute packs never expire while your Yuga account exists, but are lost if you delete it, and can’t be transferred or exchanged for money;
- on Apple devices, purchases are licensed under the Standard EULA like the app itself, and Apple’s refund obligations are as set out in section 3 (the warranty term) and Apple’s own policies.
6.Updates, permissions and internet use
The app needs an internet connection to talk to the figures. It asks for your permission before using the microphone and, on iPhone, speech recognition; you can say no and type instead, and change your mind in your phone’s settings. It doesn’t use your location, camera, contacts or photos. Sharing a clip or card uses your phone’s share sheet.
I may release updates to fix problems, improve the app or comply with the law. Some updates may be needed to keep using Yuga; your store or phone settings decide whether they install automatically. I will keep the app working as described for a reasonable time, and as long as the law requires.
7.Third-party components
The app includes the fonts Bricolage Grotesque and IM Fell English, used under the SIL Open Font License 1.1, and software provided by Apple and Google as part of their platforms (such as sign-in, speech recognition, in-app purchase and billing libraries, and system frameworks), under their own terms. Passages the figures show from their sources are public domain or used under their licence, which is displayed with the passage.
8.When the licence ends
You can end this licence at any time by deleting the app (and, if you like, your account: how). It ends automatically if you seriously break it or the Terms of Use, after notice where that is fair. When it ends, you must stop using the app and delete it. Sections about intellectual property, liability and disputes survive.
9.Warranty, liability and disputes
The disclaimers, limits on liability, governing law and dispute terms in the Terms of Use apply to the app, together with section 3 above on Apple devices. On Apple devices, where the Standard EULA chooses a governing law for the licence, that choice applies to the licence itself, and the Terms of Use apply to the rest of your use of Yuga. Your mandatory consumer rights where you live are not affected.
10.Support and contact
